According to Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, modified and supplemented on the protection of individuals with regard to the processing of personal data and the free movement of such data web.biz has the obligation to manage safely and only for specified purposes personal data you provide about you.
This Convention on "Terms and Conditions of use for web hosting service", establishes the conditions under which any person may visit or access the website www.web.biz times can be used in any way by hosting or domain registration service, and has a value of agreements concluded between web.biz (hereinafter referred to as "supplier"), in its capacity as owner and administrator of the site and the service provider, and any person visiting or accessing the site CPC or who want to use in any manner or actually use the services (hereinafter referred to as "user or client").
The purpose of data collection is offered to current service provision and registering web domains on behalf of clients and according to orders. Everyone has the right to object, free of charge and without any justification, against the processing of personal data for direct marketing purposes.
According to Law no. 677/2001, you have the right to access and modify the data, the right not to be subjected to an individual decision and the right to go to court. Also you have the right to oppose the processing of your personal data and request deletion. To exercise these rights, you may submit a written, dated and signed at contact [at] web.biz. Also, it has the right to go to court. According to the legislation in Romania minors can not conclude commercial contracts nor their personal data is not processed without parental consent.
Not accepting this Convention or any provision of this obligation attract that person to stop accessing the site or in any way use the service and still accessing or visiting the site, opening an account or using any www.web.biz mode service entirely constitutes acceptance of the Convention and any provision thereof, including any subsequent changes can be made without restrictions by the supplier, without requiring any other formality.
The publication of content on our servers or references (links) to such content that: (i) violate or prejudice in any way intellectual property rights or other rights of others; (II) have obscene or pornographic or violent nature; (III) contained defamatory or libelous; (IV) contained racist or discriminatory; (V) contains viruses, Trojan horses and the like; (VI) are prohibited sites phishing / scam; (VII) containing pirated software or for those who pirate software or practice any similar activities. It is also forbidden forums hosting games and use our servers exclusively as a storage medium or broadcast (exp. Movie sites online, download mp3, download pictures, online radios, etc.).
Proxy scripts, Anonymizer, IRC scripts, scripts of top sites, scripts online games like Counter-Strike (excluding games in flash) Mail Bomber mass mail or any script that send emails insecurely, Torrent tracker, chat rooms that consumes excessive resources and WAP chat, PhpShell and similar command execution.
Any attempt to harm servers or clients is prohibited. Any activity that affects the smooth running of the server shared hosting (examples include but are not limited to: CPU load than normal, mass mailing, queries SQL very common and / or duration) will be considered abuse and will be appreciated as an attempt to prejudice other customers collocated.
Maximum consumption acceptable for sites, CPU is 5%, 5% and 1.5% MEM / MYSQL and processes can consume up to 10% CPU consumption, higher consumption can be considered as abuse.
Sending unsolicited commercial messages (SPAM) to promote any site using our servers or third party servers promoting any website hosted by us will result in the suspension or cancellation of customer's hosting account without refund. Mailing lists can be operated in conditions where people subscribe to receive messages and publish all messages withdrawal procedure of lists.
Each hosting account is limited, so we do not allow sending more than 300 emails in a span of 60 minutes. This restriction is necessary to protect the quality hosting service. Sending massive emails cause massive consumption of resources of a server, this is having a negative impact on the quality and the services received by customers. The first violation of this policy results in immediate suspension of hosting account without refund.
Use of resources
All accounts are monitored for their use of server resources. If an account is using a large amount of server resources we will contact the customer to discuss the issue.
If an account is using a large amount of resources (memory, CPU), the account may be suspended or script disabled without notice to maintain the smooth running of the server within 24 hours of sending out notices of consumption.
Customers can request a package upgrade or temporary resource. Customer's sole responsibility to contact us in advance of requiring extra resources to prevent account suspension.
Resource allocation for each package separately:
Cloud Starter – 20% CPU, 20 simultaneous processes, 400 MB RAM
Cloud Basic – 30% CPU, 30 simultaneous processes, 600 MB RAM
Cloud Premium – 50% CPU, 40 simultaneous processes, 800 MB RAM
Cloud Business – 60% CPU, 60 simultaneous processes, 1024 MB RAM
WP Starter – 25% CPU, 20 simultaneous processes, 512 MB RAM
WP Basic – 35% CPU, 30 simultaneous processes, 800 MB RAM
WP Premium + – 55% CPU, 40 simultaneous processes, 1024 MB RAM
WP Business + – 65% CPU, 60 simultaneous processes, 1280 MB RAM
Magento Starter – 35% CPU, 50 simultaneous processes, 1 GB RAM
Magento Basic – 45% CPU, 80 simultaneous processes, 2 GB RAM
Magento Premium – 55% CPU, 100 simultaneous processes, 3 GB RAM
Magento Business – 65% CPU, 120 simultaneous processes, 4 GB RAM
Customer is responsible for updating contact billing information from control panel when necessary. We can not be held responsible for communication mixup as a direct result of failure by the customer to update their details. Customer is responsible for keeping security usernames, passwords and other sensitive information.
We can not be responsible for damage caused by the temporary unavailability of our servers, for any reason that causes this. This includes damages resulting from damage or loss of data. Customer agrees to indemnify and consider us harmless from any claims, damages, including without limitation, damages caused to third parties arising as a consequence of using the service which damages our client. User declares that understands and accepts that in any situation where the user will claim damages from any supplier, the total amount of damages requested by the user for any reason and that might be paid by the supplier shall not exceed in any manner and in any case the total amount of tariffs (taxes) paid by the user to the supplier.
Web hosting services offered by our company guarantees an uptime average of 99.9%. If an uptime less than the guaranteed supplier undertakes, upon request of the company to credit his account, percentage of the value of the monthly subscription as follows: 10% uptime between 99.9% and 99%, 25% uptime between 99% and 98%, 50% uptime between 98% and 95%, 75% uptime between 95% and 90% and 100% to less than 90% uptime.
These are exceptions:
Force majeure in which we can not have any influence such as wars, natural disasters, unavailability / interruption of communications, fire, viruses, hackers, and malfunction of the software provided by another source (free scripts, ecommerce software or online payment processor), flood, earthquake, embargoes, actions of legal authorities. Maintenance work announced or in critical situations, upgrades of servers.
Backups are made daily all files, mailboxes and database via backup solution offered by the company R1Soft on external storage. However we do not offer any guarantee for the integrity of backups and server data backup are stored within 7 days.
All clients are required to download their own backups from the control panel, from Backup option. The provider is not responsible in any way for the loss of information hosted on servers due to the actions of users, type of hacking attacks, or due to errors in applications that are not associated with the service. For example, the control panel is not associated with the service and is not provided by the supplier, developed and offered by cPanel.net.
If it exceeds 30 days of non-payment and the account is deleted from the server, the client can request the reinstatement of the site from a older backup. If this will be possible will be charged with a sum of 25 euros this service, unless it has successfully completed recovery site.
We do not allow the running of scripts by cron set at less than 30 minutes.
CGI scripts can be used by our clients as a part included in the services offered, but any CGI script specifically designed to negatively affect server performance or network integrity may be closed without notice.
We do not allow the use of chat rooms on our servers due to special requirements of these programs.
Installation of additional services
If the script that you want to use requires server activation, web.biz has no obligation to install those programs, unless they consider that their activation would not adversely affect the stability or security of the server. Any request for account upgrade (space / traffic / other package) is via email or support ticket with at least 24 hours before the change. We take no responsibility if you do not upgrade your account and run out of space or traffic.
Notifications and Announcements
web.biz reserves the right to send notices concerning services and offers and ads from third parties, when they can have the benefit of users.
Terms of payment and invoicing
Customer agrees to pay for services in advance of the time period in which they are provided. Customers must pay the bill in advance at the beginning of each pay period, within 5 days from the invoice issue date.
Customers who want to close their hosting account or any service should send an email notification with at least 30 days before due date.
Prices in Euros are calculated in RON at the exchange rate of the invoice issue date, according to the legislation all invoices and payments are processed in RON.
Active promotions on our website applies only to new orders made during the promotion. Same services previously ordered might not be part of current promotions.
Domain registration rules
The domains with .ro extension are registered indefinitely (life) as long as ROTLD does not starts steps to introduce an annual fee as in the case of foreign registrar. The beneficiary understands that web.biz only provide mediation reservation of domain names and accepting the terms and conditions imposed by each registrar. The beneficiary understands that acceptance of these terms is a contract between him and the Registry and Supplier is a third compared to this contract.
All domain registrations for .ro obey the rules set by ROTLD and can be read on Rules of registration and contract registration made available by your ROTLD annual Forum Rules of domain registration
.ro Domains that offers customers the annual period are made available to them in the form of rent and the cost / fare paid is the cost of renting these domains during a year.
These domains are not registered on behalf of the client, but only the right to use it will be the first applicant of that domain, which previously paid equivalent to, but the applicant at any time can become the rightful owner of the domain, asking us to transfer the domain in his property.
The transfer fee is 39.9 euros and is paid to web.biz. Transfer domain in the client's property is only through us and we do not accept transfers directly through ROTLD or another registrar. The transfer procedure in the field of customer property lasts 30 days.
Once the domain expires and placed freely is the right of every natural or legal persons to purchase that domain.
Account suspension for unpaid services
User accounts who have not paid the fees for the service within 10 days of the issued invoice will be suspended until payment confirmation, according to the above. The supplier may reopen their accounts closed for nonpayment of charges only after full payment of all amounts owed by the user.
We guarantee your money back in 30 days
Every customer has a warranty of 30 days. If during this period you are not completely satisfied with the quality hosting service you can request and receive back the money paid in advance.
The following services are not included in warranty of 30 days: fees for registering domain names (national and / or international), fees paid for Dedicated Servers, VPS Servers services ordered as a reseller, and any other fees paid for optional services (cPanel licenses, licenses of Softaculous, etc) / special other than the standard offer.
If the cancellation is due account of the client's breach of these terms and conditions no refund will be made. Money back guarantee payment within 14 days of placing the order does not apply and will not be made if it was used at least 50% of allocated data transfer hosting account that the subject of the application for reimbursement.
Through affiliate program you can earn 25% of the packages for VPS hosting or dedicated servers ordered. Domain registration service is not included in the affiliate program.
How does this work?
Each affiliate will receive a unique reference link like http://client.web.biz/aff.php?aff=001. When a visitor on your site connects to our site through this unique link reference, our system will automatically record customer services ordered. After paying services, you'll see in the affiliate account fee 20% of the services ordered.
Payment of fees will be made after a period of 30 days if it reaches a minimum amount of 100 RON. In the case of online payment the deadline of fees can be up to 60 days to avoid fraud.
We reserve the right to make additions, cancellations or changes in the Terms and Conditions, our hosting packages, prices in the site at any time with notice provided via the website or customer client area.
